Per information released by Israel, at least 98 Palestinian individuals have perished while in custody beginning in October 2023. A rights monitoring body operating from Israel has reported that the true toll is probably substantially larger, due to many of unaccounted for individuals from Gaza.

Detention Conditions

Systemic Abuse

The systematic abuse was accompanied by a troubling surge in fatalities recorded across no fewer than 12 prison sites in Israel. Over ten years preceding the war, there were typically several deaths a year.

“This isn’t just an individual case here and there. It is systemic and it will continue,” an official stated, partially because there is a culture of near total impunity for killing and mistreating detainees.

Merely one incident of assaulting detainees has proceeded to court, with the military personnel handed a punishment to half a year. An attempt to prosecute other suspects over a severe beating involving abuse led to right-wing protests and the apprehension of Israel’s senior defense attorney, with the suspects now demanding that indictments against them be withdrawn.

Lack of Accountability

“In spite of this mass number of deaths, during 24 months not one individual has been arrested,” the spokesperson noted. “There have been no indictments over any death.

“During the time these measures remain in effect, each Palestinian individual in confinement is in danger, also the those in good health, even the youth who have no health problems.”

Notable Incidents

Certain fatalities in confinement have been publicly known, for instance a middle-aged healthcare leader who lost his life in confinement after 120 days in confinement.

A detainee held with the deceased stated that he was taken to the courtyard by guards shortly before his passing, clearly wounded and naked from the waist down. His body has not been returned to Gaza.

Further inmates who lost their lives in detention in Israel stay unnamed. Correctional authorities and defense forces gave researchers with the total of deaths in detention, and limited further data such as the location where they died, but not the detainees’ identities.

Documentation Problems

In 21 cases, mostly individuals from Gaza, researchers were unable to connect the minimal data supplied by authorities to a fatality registered by rights organisations, via testimony from former inmates or accounts in the media.

The inmates’ next of kin could be unaware about their family members’ fatalities also, as Israel has made it difficult to track Palestinian individuals it is holding. During 210 days at the start of the conflict, the defense forces declined to provide basic information about the whereabouts of thousands of persons held in Gaza, in effect carrying out a policy of forced disappearance, as stated by the human rights group.
